Last week the Court of Appeal made a decision in divorce cases overturning over 18 years of legal precedent. In divorce cases under the new ruling, if a Husband or Wife finds information documentations showing their spouse was hiding assets, then such evidence was not to be allowed in Court. It is therefore more essential than ever that you make sure that you get the best legal advice possible before starting the divorce process.
At Chafes Solicitors, our best advice would be that if you find any evidence that your spouse has hidden assets, you should inform your solicitor straight away so that they can ask the other parties solicitor to produce them. Do not take any papers that you do not own! The consequences of this are severe and you end up with sanctions against you and you will not be able to use the documents in Court.
Our advice in the first instance would always be to try and resolve the matter without the need for Court – this could save most parties lots of money, time and stress.
