All unions are susceptible to divorce, unfortunately, but as research has shown that same sex couples are less likely to divorce, it is now reasonable to argue that we should allow same sex couples exactly the same rights as married couples. Essentially, these findings produce a credible argument with which to counter those who would argue that allowing same sex couples to marry debases the institution of marriage.

Thanks for the comment. I agree that there may well be cases where mediation is not appropriate.

Just because, for example the domestic violence exemptions don’t apply, there may still be an imbalance in the parties’ relationship which makes one party feel that they cannot participate fully in discussions.

Whilst shuttle mediation can take place it may still not be sufficient for one of the parties’ to feel they can set out their position.

The new rules will hopefully provide the parties with an opportunity to reflect on whether or not everything reasonably possible has been done to attempt to settle issues without the need to embark on lengthy, emotionally draining and costly court proceedings.

In theory I think mediation is a good thing. It is something that a lot more divorcing couples should consider. But that doesn’t mean it is appropriate for all cases. I think it should be promoted but not forced upon people.
